WinSport Hockey Canada League Team Agreement Summer 2024 Season
WHEREAS Calgary Olympic Development Association, operating as WinSport (“WinSport”) has agreed to place your team (the “Team”) in a division of the WinSport Hockey Canada League (the “WHCL”);
AND WHEREAS the Team has been invited by WinSport to join the WHCL for the Summer 2024
 hockey season, including playoffs, if any (the “Summer 2024 Season”);
AND WHEREAS the Team Representative would like to enter the Team in the WHCL;
AND WHEREAS the Team Representative agrees that the Team is joining the WHCL and will abide by its rules and regulations;


The Team Representative, in their personal capacity and in their capacity as agent of the Team and its members, and WinSport agree as follows:

1. Facility Use: The Team, as a member of the WHCL, has the right to utilize WinSport’s arena and dressing room facilities for the purpose of playing Adult Recreational Hockey during its scheduled game times throughout the Summer 2024 Hockey Season in accordance with the terms of this Agreement. 

2. Compliance: The terms of this Agreement apply to all members of the Team, spare players, and all other individuals associated with the Team’s participation in the WHCL (collectively, the “Team Members”) while in attendance at WinSport’s facilities. The Team Representative is responsible for ensuring awareness of and compliance with this Agreement by all Team Members and the Team Representative will be held responsible for any breach of any term of this Agreement by any Team Members, unless explicitly stated otherwise herein. In the event the Team Representative is not available or otherwise not able to fulfill the responsibilities and obligations set out herein, the Team Representative shall appoint a delegate. For clarity, the Team Representative shall at all times remain responsible for all responsibilities and obligations herein, including any acts or omissions of their delegate(s).

3.Payment of Fees:  The fee for the Team to participate in WHCL for the Summer 2024 Season is:

Returning Team: Six thousand four hundred dollars ($6,400)
New Team: Six thousand seven hundred dollars ($6,700)
(each, the “Fee”)
 
Individual player fees will be collected by the Hoser Hockey League and the team fees are payable by the Hoser Hockey League to WinSport by April 19, 2024. #concent#
If the Team Representative fails to pay the balance owing by such times, the Team will forfeit its spot in the WHCL. However, WinSport, at its sole discretion, may extend this deadline in writing subject to the Team Representative paying a $300 administrative fee.  If the Team is suspended or expelled from the WHCL for any reason other than a cancellation of the league or the Team’s division by WinSport, the Fee or any installment thereof will not be refunded to the Team and the Team will have no recourse against WinSport for such suspension or expulsion.

4. Joining the WHCL:  Once the Fees are paid in full the Team will be considered a team in the WHCL. 

5. Games and Scheduling: The Team Representative acknowledges that WinSport has the right to alter game times as required to accommodate other events at WinSport’s facility and as required due to facility emergencies or maintenance.  WinSport reserves the right to reschedule any team’s games due to a divisional move at any time throughout the season.  

6. Agreements: The Team Representative agrees, on behalf of him/herself and on behalf of the Team, to abide by the terms of this Agreement, the WHCL Code of Conduct and the WHCL Manual & Official Rule Book (the “WHCL Rule Book”), as well as all rules posted at the facilities or delivered to the Team Representative by WinSport, and as amended from time to time.

7.Insurance: It shall be each Team Member’s responsibility to familiarize themselves with, and abide by, the WHCL Insurance program. The Team Representative acknowledges and agrees that they shall ensure that each Team Member is aware of this requirement.

8. Mandatory Equipment:  Helmets and equipment are mandatory as governed by insurance.  Players will not be allowed on the ice without the mandatory helmet and equipment.  Further details about the mandatory equipment are set out in the WHCL Rule Book. 

9. Common Areas: All Team Members will obey all rules and regulations posted by WinSport regarding use of common areas, meaning those areas and facilities that are provided or designated from time to time by WinSport for use in common by WinSport, the Team, and any other third parties, and all Team Members shall at all times be respectful when using common areas. WinSport is not responsible for lost, damaged, or stolen articles.

10. Damage to WinSport Property:  The Team Representative is liable for any damage or loss or theft to the WinSport facility or property caused by the Team Representative or any Team Member. The Team Representative shall pay for any and all damage to the property of WinSport or loss or theft of such property, done or caused by any and all Team Members or the Team Representative in relation to this Agreement.  All amounts owing need to be paid before the Team’s next scheduled game. The Team’s scheduled games will be suspended if accounts are not up to date.

11. Liability for activation of emergency sprinkler system or alarm system:  Anyone activating the emergency sprinkler system and/or alarm system without cause to do so will be required to pay for damages/lost revenue and resulting expenses and may face criminal charges.  Such action may result in the Team Member and/or Team being suspended or expelled from the WHCL upon notice from WinSport.  All amounts owing need to be paid before the Team’s next scheduled game. The Team’s scheduled games will be suspended if accounts are not up to date.

12. Limit on Liability for Property:  WinSport does not accept any responsibility for any loss of or damage to property of any Team Member. Each Team Member will at all times assume all risk of and be solely liable for any damage to, loss or destruction of, or loss of use of any property of a Team Member, while such is located at Canada Olympic Park, whether caused by or contributed to by any act or omission of WinSport, including without limitation any type of negligence. 

13. Additional Prohibitions:  Anyone found throwing debris onto the ice surface or using vulgar language will be immediately ejected from the facility.

14. Parking and Traffic:  Parking is available at Canada Olympic Park. All vehicles must be in spots identified for parking.  All fire exits, hydrants, doors or any other marked must be kept clear.  Vehicles parked in violation of this Section will be towed or removed at the owner’s expense. All patrons at Canada Olympic Park must obey all traffic laws at COP and any traffic or other directives provided by WinSport staff.

15. Restrictions on access to Facilities:  Bicycles, skateboards, scooters, heelies, and pets are not permitted within the facility, except guide dogs or other service or working dogs.

16. Access to Facilities:  Participants and spectators may enter and exit through the Event floor entrance located on the east side of the building or the main entrance on the Spectator floor.

17. Food and Beverage: WinSport has exclusivity over all food and beverage provided at Canada Olympic Park. The Team may not bring any food or beverage to COP unless the same was purchased from or catered by WinSport. The Team may not sell any food and beverage at COP.  


18. Additional Rules:  Any items not covered in this agreement will be governed by the WHCL Rule Book posted online at http://winsport.goalline.ca. The Team must follow the WHCL Rule Book at all times.  WinSport has the right, at its sole discretion, to eject any player or team acting in violation of the WHCL Rule Book. The WHCL Rule Book can be changed by WinSport at any time and such changes shall be binding upon the Team and Team Representative upon written notice. If there is any conflict between this Agreement and the WHCL Rule Book, the more stringent provision will apply.

19. Accidents and Injuries: The Team Representative will notify WinSport immediately on becoming aware of any accident or injury occurring at WinSport’s facilities.

20. Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement:  Participation in the WCHL is subject to completion of WinSport’s Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement by each Team Member prior to participating (the “Waiver”). The Waiver can be viewed and completed on Goalline. In the event such Waiver is not completed prior to the Team Member’s first game, participation in the WHCL shall not be permitted.

21. Exclusion of Liability: Without limiting Section 20, the Team Representative acknowledges and agrees that WinSport’s Exclusion of Liability and Assumption of Risk Notice, which is posted throughout COP, applies to all Team Members. The Team Representative acknowledges that, as set out on such Notice, as a condition of use of WinSport’s facilities and participation of activities at COP, each individual attending at COP assumes all risk of personal injury, death or property loss from any cause whatsoever including negligence, breach of contract, or breach of duty of care owed under the Occupiers’ Liability Act by WinSport or its employees or representatives.

22. Health Orders: The League Representative shall ensure that all Teams follow all applicable Government of Alberta Orders and Guidelines, as well as all WinSport rules, regulations, and policies, related to public health.
 

23.General Terms:  This agreement, including the WHCL Rule Book (as amended from time to time) and the Waivers signed pursuant to this Agreement form the entire agreement between WinSport and the Team Representative with respect to the Team participating in the WHCL.  This Agreement will be governed by the laws of Alberta and the laws of Canada applicable therein.  This Agreement can only be amended by written agreement between the parties, with the exception that WinSport can (i) unilaterally change the WHCL Rule Book at any time upon written notice to the Team Representative; (ii) require any or all Team Members to complete and sign updated Waiver(s); and (iii) unilaterally update any rules or regulations. 

24.Term and Termination: This Agreement comes into force upon signing and terminates the earlier of:
  • the Team Representative failing to pay the Fee in accordance with this Agreement;
  • The Team being expelled from the WHCL by WinSport in accordance with this Agreement; or
  • The first day immediately following the Team’s last game of the Summer 2024 Season.


25.WinSport’s Remedies:  In addition to any other remedy WinSport has in law or equity, if the Team or any Team Member violates any term of this Contract, including the WHCL Rule Book or any other rule set out herein, WinSport may impose a sanction on the Team and/or the applicable individual, at WinSport’s sole discretion, which sanction may include fines and/or suspension or expulsion from the WHCL. 

26.Privacy, Recording and Broadcast: WinSport has established a privacy policy to govern its collection, use and disclosure of personal information in accordance with relevant privacy legislation. The policy is available upon request and it is each Team Member’s sole responsibility to review the policy. If any Team Member does not read the policy, such Team Member is nevertheless bound by its terms.

The Team Representative acknowledges that it is aware that the WinSport Arenas may be monitored by video cameras for security, safety and commercial purposes and any attendees at the Arenas are deemed to have consent, and waive any claim relating, to the capture or broadcast/public transmission (video or audio) of their attendance and participation at the Arenas. 


The Team Representative shall be solely responsible to notify and advise all Teams of the aforesaid monitoring and video and audio broadcast/public transmission.
